Caterers Obligations

The Caterer will:

  • Perform the Catering Services.
  • Comply with the terms and conditions of the Venue Rental Agreement to the extent that those terms and conditions are relevant to the Catering Services.
  • Comply with laws, including but not limited to all applicable federal, provincial and municipal statutes and regulations and all judgements, rulings, orders and directions of courts, government agencies and authorities having legal jurisdiction.
  • Comply with the AAM’s Policies, as attached.
  • Use due care and due diligence to ensure that the people the Caterer employs to carry out the Catering Services are experienced, are qualified for the work for which they have been hired, have positive interpersonal skills, and do not pose a risk to the safety, security or health of the AAM’s staff, or patrons of the AAM and do not represent an adverse security risk for the organization.
  • Arrange and keep in full force and effect insurance covering the Catering Services activities at and around the AAM including the following coverages in the following minimum amounts:
    • Workers’ Compensation Insurance including Personal Optional Protection insurance for proprietors of non-incorporated entities and their spouses, if those persons work on the Catering Services at the AAM;
    • Comprehensive General Liability Insurance, at least $5,000,000 per occurrence;
    • “All Risks” property insurance for physical loss or damage to the Caterer’s furniture, fixtures, stock, equipment, and all other property owned by the Caterer;
    • Liquor Liability Insurance (liability for the service of intoxicating beverages), with a coverage limit of at least $5,000,000 per occurrence;
  • Ensure that each of the Comprehensive General Liability Insurance, “All Risks” property insurance, and Liquor Liability Insurance policies:
    • Name the AAM as an insured or additional insured;
    • Contain a waiver of subrogation in favour of the AAM; and
    • Provide that they cannot be cancelled without thirty (30) days’ prior written notice to the AAM;
  • Provide proof of coverage to the AAM evidencing the insurance required under this Agreement.
  • Not delegate any part of its duties in providing the Catering Services during the event at the AAM to any other person, corporation or entity, including affiliates or associates of the Caterer, without the AAM’s prior written consent, and agrees that the Caterer will be liable for activities or inactivity of any person to whom any obligation is delegated or subcontracted.
